Hardly surprising - trying to forcibly turn an overloaded inflatable in mid-channel is a murderous idea, and they'd still be obliged to rescue them under the international law of the sea if the inevitable happened. I assume this is what persuades them to escort the inflatables to shore in preference to trying to offload the migrants in mid-channel, either would be liable to tip the whole lot into the drink, non-swimmers as well as swimmers! What then?

Im not championing anything. Simply pointing out that whatever the figure was we could officially send back its now Zero because we are no longer part of that agreement and it just happens to coincide with a year of record numbers crossing everyday. Why do you think Cruella was pleading with the EU to let them cherry pick that part of the agreement? Now they are stuffed. They cant do anything and are having to pay the French to not do a very good job of stopping migrants leaving.

 

Its just another Brexit own goal isnt it? Still, it gives Nige something to do getting all shouty at the sea from the White cliffs of Dover. (lol)

(a) makes a request to be recognised as a refugee under the Refugee Convention on the basis that it would be contrary to the United Kingdom’s obligations under the Refugee Convention for them to be removed from or required to leave the United Kingdom, or

 

(b) otherwise makes a request for international protection. “Application for asylum” shall be construed accordingly.

 

327A. Every person has the right to make an application for asylum on their own behalf.

 

327B. A designated place of asylum claim is:

 

(i) an asylum intake unit;

 

(ii) an immigration removal centre;

 

(iii) a port or airport;

 

(iv) a location to which the person has been directed by the Secretary of State to make a claim for asylum; or

 

(v) any other location where an officer authorised to accept an asylum application is present and capable of receiving the claim.

 

327C. If the officer is not capable of receiving the claim, they will direct the applicant to a designated place of asylum claim.

 

327D. An officer is not capable of receiving the claim in the territorial waters of the United Kingdom."

 

The only question that needs to be answered is how rule 327 above, but especially 327A, which confers a right to make a claim for asylum, can be complied with, unless the applicant is already in the UK, or at a place described in 327B (v)?

 

I have no idea how the French would respond to a UK request to establish a migrant clearance centre on French soil (which seems to me the obvious answer), but as no such centre exists I assume either the French said "non", or the UK government is reluctant to do so. That being the case, as the French have no blanket obligation to prevent people leaving France for the UK (only a "best endeavours" agreement to prevent them doing so in a hazardous manner), the migrants must first cross the Channel before their applications can be made. It is not illegal to cross the Channel for the purpose of claiming asylum or refugee status.

 

The legal onus then falls on the UK to receive, and determine, their claim and either take them in, or return them to "any country or territory:

• of which they are a national or citizen

• in which they have obtained a passport or other document of identity

• to which there is reason to believe that they will be admitted

• from which they embarked for the UK"

You "think" 1200 ... So thats "1200" returned to France from I presume the start of young male professionals starting to come here till a year or so ago??? ... I think it was about 230 that were returned back to France in the year before we left the EU properly. So maybe the figure was more than 1200, dunno but for sure if it was about 200-300 a year that got sent back thats 200-300 more than they can return now thanks to Brexit and its off the scale now since we left the EU compared to before. Another Brexit bonus eh?

With the Tories seemingly not really giving a toss about none EU immigration which is now at the highest levels since records began and all these migrants coming over in dinghies it seems the main thing the Brexiteers thought Brexit would deliver has totally gone tits up. Oh dear.

During the period you quote, nearly two years 231 young male professionals were sent back to France because of your precious Dublin Agreement ... In that same period thousands and thousands broke into Britain ... That paltry figure returned to war torn France is your reason for championing the Dublin Agreement??? ... Tell us again how many you have taken in while preaching away "we must do more", you do keep forgetting to answer

 

Im not championing anything. Simply pointing out that whatever the figure was we could officially send back its now Zero because we are no longer part of that agreement and it just happens to coincide with a year of record numbers crossing everyday. Why do you think Cruella was pleading with the EU to let them cherry pick that part of the agreement? Now they are stuffed. They cant do anything and are having to pay the French to not do a very good job of stopping migrants leaving.

 

Its just another Brexit own goal isnt it? Still, it gives Nige something to do getting all shouty at the sea from the White cliffs of Dover. (lol)
