Dash cams in Portugal

Anybody had any problems using a dash cam in Portugal, read on another forum that it is illegal to film persons or property without their permission. The person in question was fined, I am well aware that this is a statement from an unknown person who friend was fined? But I still pose the question as it seems that the camera would be more of an advantage, especially have having just been forced to mount the verge to avoid an artic cross the line on a bend.

If there is a Portuguese law that makes using a dash-cam illegal, it won’t matter how beneficial dash-cams are thought to be or how daft one might think that law is, there will always be the potential to be prosecuted.

 

It’s a bit like A-frame-towing a car in Spain. It’s generally understood that the practice has always contravened Spanish law, but plenty of motorcaravanners have done it for years and never been prosecuted.

There doesn't appear to be anything in Portugese law which makes posssessing or using a dashcam specifically illegal, it just limits the use you can make of the video clips you gather, rather like our Data Protection Act might do with data which deemed to be personal.

 

In essence you might find that you couldn't use dashcam video clips in court, maybe not even in a civil case, but there is nothing to say you have to take your dashcam off and hide it away when you enter Portugal.  It would appear that you should leave your dashcam running in Portugal because it might be useful if you have an accident - but there might be an argument if you want to use it to identify an individual because you can see their face, or less likely because you have captured their registration number.
