Cummings accused of perverting course of justice

Police and the Crown Prosecution Service have been handed a 225-page dossier urging them to investigate Dominic Cummings for allegedly perverting the course of justice, in relation to a statement about his journeys to the north-east of England at the height of the pandemic.

 

The former regional chief prosecutor Nazir Afzal said Cummings’ claims during a press conference in Downing Street’s rose garden on 25 May affected the course of justice as they were made as Durham police’s investigation into his behaviour was already under way.

 

In a statement, Afzal’s lawyers said: “The alleged offence of perverting the course of justice arises from Mr Cummings’ statement in the rose garden … Mr Cummings made public assertions about his conduct at Barnard Castle on 12 April and his actions on the weekend of 17-19 April that appear to be wholly inconsistent with accounts of his conduct at that time obtained from eyewitnesses.”

The police won’t be interrupting the Queen’s speech by kicking in your front door to demand proof of address,” he said. “You only get people to adhere if they feel the whole community is making sacrifices. But that went out the window when we saw what Dominic Cummings was doing – and I expect most of us think other government figures do it too.”

Cummings has become a Darth Vader-type character in th eyes of many and there are those who are determined to see him done down because of his prominence. At the time of his trip from London to Durham and the excursion to Barnards Castle he was however acting alone simly as a father of a family under threat of COVID infection and he went to his family home in Durham where he could rely of getting somefamily support. This was a time when we knew little about the disease and lots of people were doing things like this in desperation because catching the virus seemed almost like getting a death sentence and his family needed help. I could identify with his desperation and the actions he took and I had sympathy for his actions.

 

Durham police looked into it all and said there was “no intention to take retrospective action in respect of the Barnard Castle incident since this would amount to treating Mr Cummings differently from other members of the public”. But a retired Prosecutor, Mr Afzal, seems to be a on a mission to force what would appear to be disproportionate action, want Cummings charged with perverting the course of justice, seemingly simply because there were conflicting witness accounts of what actually happened. Mr Afzal's motives are not clear but he seems to have a bee in his bonnet about this and has submitted information and argumant demanding further investigation. Maybe the Durham police or the Durham CPS will look at it all again and maybe they won't but I dont see it as something Mr Afzal has any more right than any or us to press for, especially if he is on some sort of personal mission.

You have a short and selective memory Stuart. Matt Hancock said in the HoC on March 16th, "all unnecessary social contact should cease"......Johnson gave a public announcement on March 23d that "people ‘must’ stay at home".

 

Five days later Cummings, his wife and child, left their home in London to drive up to his parents house at Durham ("people must stay at home" - Johnson March 16th). His wife was later to write in her Spectator blog describing the anguish of watching as her husband “lay doggo” with Covid-19 for 10 days before they emerged from quarantine “into the almost comical uncertainty of London lockdown”.

 

Absolutely zero mention of the fact they'd gone to Durham and were not at home in London at all, and describing her Covid bed ridden husband who "lay doggo" for 10 days yet the same man packed and drove the family off up to Durham. Hallelujah.....it's a miracle. Lazareth has risen!

 

Cummings claimed their decision to go to Durham was in case they needed childcare. Well i'm sorry but that is as lame as his excuse for "testing his eyesight". How do they think single parent families cope?

 

A lot of people have been in a desperate situation but obeyed the 'stay at home' rules. Some who didn't have been handed extremely heavy fines.

 

Whats different between the previous outrage over Cummings Durham and Barnard Castle "jolly" is this is a specific legal document levelling specific charges with supporting evidence, written by people who understand legal cases. This cannot simply be dismissed the same way as before - the document, in effect, sets out a legal case which justifies prosecution under the exact terms of the relevant law. There will be no ‘we reviewed the evidence and it’s not strong enough’ line with this; the people who write it know how much evidence has been needed in cases before and if that line gets pushed they can take it to review.

 

Also they’re not bringing a case under the COVID regulations which we all know are vague and legally spotty, they’re going after Cummings for ‘perverting the course of justice’ which is a long standing and well understood piece of legislation, with a long history of prosecutions and precedents to fall back on. It doesn’t mean those in power won’t try to bend the rules to get Cummings off, but this time unlike last time they’re facing a group of people who know the rules if anything better than they do.

 

Will it succeed? Johnson will do everything he can to get it shut down.

I dont think its just that. Its Brexit again. By now any rational thinking person would agree that the current government is totally hapless and has totally failed us all on every front from Brexit to handling Covid. However many long term Labour voters turned blue for Brexit and many long term Tory voters are so Brexit obsessed it was all that mattered so they all voted in someone who in normal times would never have got anywhere near number 10. Now, they are so heavily invested they cannot bring themselves to admit what a colossal mistake they have made. For many I suspect its just too much to bare.

He was effectively saying to us all - f*ck you, I can do what I want. And there is nothing you can do about it.

Indeed it caused uproar here and we were feeling the effects of his little Jaunt to Barnard Castle for months afterwards. It put Barnard castle on the map and tourist enquiries and visitors were up 160% right when we didnt want them. Not only that but the local facebook groups were alive with morons saying if he can flout the rules so can we. There is no way in a million years he should have been allowed to carry on working in Government after that but this is what we are up against now. They just see themselves as untouchable and unaccountable. Some of the very traits they were against the EU for. Oh yeah and cummings is an unelected bureaucrat.
