Perhaps we should also give a mention to the judges, the way they are appointed and perceived lack of accountability.

 

Accountable to whom? There are onward appeals available if they get it wrong. They are beholden to the law. Would you have it any different?

 

Accountable for poor judgment. Mistakes even. When was the last judge fired?

 

 

Maybe we should replace judges with an algorithm ?

 

I've heard that they make quite fair / reliable decisions.

There are poor judges for sure. Nevertheless, I have friends that are Judges and all of them are top notch and are extremely hard working. They would not claim to be infallible. They are the same as you and I except perhaps a lot brainier. Which one of us has not made a make mistake in our jobs? Do any of us believe that every mistake demands dismissal? If a Judge is found guilty of misconduct, they are removable (anyone remember Constance Briscoe?). Judges are also subject to regular appraisals and if found to fall short of expectations they can be made to take steps to improve their performance. In terms of their appointment they secure a post after being scrutinised by the Judicial Appointments Commission (JAC). Gone are the days when they were a “shoe-in” after a “tap on the shoulder” from a mate. Examples of the selection process for judicial office can be found on the JAC website. A rigorous process of written examinations, interviews, mock courts etc are part of the selection process. The JAC then make recommendations and the final decision on their appointment is taken by the relevant person e.g. The Lord Chancellor in some cases. The Judicial Conduct Investigations Office (JCIO) that have to power to investigate complaints against judges. Their decisions are made public online, just google the JCIO and you will find results of their investigations. The idea that Judges are free agents and able to apply their personal political, or any other bias to their decisions is fiction.
