I found this which throws some light on some of the issues. There are over half a million Commonwealth-born people living in the UK who arrived before 1971. All we hear about a number much much smaller than that who have had problems proving their status/right of abode. Interestingly Mr Goodhart said on the channel 4 programme that the issue about the destruction of landing cards being an impediment to the people who arrived on the Windrush is a red-herring because as they were British they wouldn't have had to fill them out.

It started a hare running which led to this Wiki entry: http://tinyurl.com/y7kukwwz I think I now begin to understand why the Windrush Generation may have got into the predicaments in which they now find themselves, and to some extent why Home Office ministers and staff may have failed to properly interpret their legal status!

 

It seems to me to need a team of specialist lawyers to be on tap to establish the timelines and sequences of events, and which Acts were in force at the relevant times, to determine who is entitled to which form of British Citizenship.

 

Until I read this, I had thought it must be reasonably clear - now I'm convinced that clarity is almost the only thing lacking! I don't blame the author of the Wiki piece, it is just an appalling legal maze with pitfalls for the unwary scattered all across it.

 

I don't think any normal mortal should be expected to negotiate its twists and turns without specialist legal guidance.

After Rudd told the Select Committee yesterday there was no removal 'targets' set at the HO today she said in the HoC targets will be abolished. Hhmm......how do you abolish something that yesterday didn't exist? :-S

A lady here who came to UK as a 9 year old child, passport stamped 'indefinite leave to remain', then on expiry of passport she got another which got lost ....with that her nationality went and she's spent 20 years battling to get another passport. Missed family funerals, weddings and reunions because she can't travel. Worked all her life for the local council, paid NI contributions etc......but feels stateless.

English being a second language doesn't mean they cannot speak the language! My ex-wife spoke five languages fluently including English and that wasn't even her fifth language let alone second.

Whilst it's certainly about people it's nigh on impossible to separate it from politics, irrespective of party, as politicians introduced the laws, acts and changes which finally brought this misery about. It's clear that May's 2014/16 Immigration Act has been the fuse which lit the powder keg. She was the chief architect of it during her tenure as Home Sec which is the only reason she's not fired Rudd. The warnings were there but went unheeded so it was only a matter of time before the lid blew off. Had it been Cook or Straw under Blairs Government, i'd have held exactly the same views.

 

There was an interesting exchange between John Woodcock MP on the Home Affairs Committee with Rudd dancing around questions to avoid answering. Sarah Jones MP also raised some interesting points. It's a long read but worthwhile.

An interesting article here on a lesser known scandal involving the Chagos Islands and imperialist UK;

Since being forced out of their homeland, the Chagossians have faced extreme racism and poverty. Many valiantly fought for their right to return, and continue to do so, but so far they have been unsuccessful. The campaign continues. But today, many Chagossians in the UK face an altogether different challenge.

How right you are Brian. So many messes created by so many governments of varying political persuasion. In addition to your link which showed the mind-blowing complexity of nationality law there has been a recent trend in immigration controls being reduced to a tick box exercise which has its origins in the introduction of the points-based system by the last Labour government. It is this tick box culture which appears to have contributed at least in part to the “Windrush” debacle. I have had recent experience of helping a friend with their son’s application to stay after his studies in the UK in a points-based category that I researched for him. It was a nightmare as regards complexity and so obviously fails to address the need to sift out the genuine migrant from the one who manipulates the evidence so as to guarantee the ticking of the relevant box. The law of unintended consequences appears to prevail when it comes to the legislation and statutory instruments dealing with immigration.The Law Commission is now charged with the job of simplifying the immigration rules. Good luck to them.

After receiving the offer for the Home Office, he told Sky News: "What has to be done is that my citizenship rights have to be reinstated."
